Rules unconstitutional the provision imposing the defendant, who has fully won the case, the obligation to pay the remainder of the judicial fee, requiring him to claim the amount he has paid as part of the party’s costs (“custas de parte”), as a result of the article 14^th, number 9, of the Litigation Costs Regulation (“Regulamento das Custas Processuais”).
